On Tuesday, December 6, the Council of State will deal with the appeal lodged by the KNAC against the decision of the Utrecht District Court in connection with the environmental zone in Utrecht. On 10 January, the Utrecht District Court ruled in which it considered a number of objections well-founded, but nevertheless decided to maintain the environmental zone. The KNAC, opposed to the environmental zone since 2013, did not agree. The session starts at 10 hour.

Just back in time. The Court of Utrecht initially annulled the traffic decree of the municipality of Utrecht. The KNAC's objection to that decision was even considered well-founded. The Court also considered the effect of the environmental zone set to be marginal. She found it not in line with the results published by the municipality of Utrecht.

Still open questions

The KNAC argued that the zone causes considerable costs. Both the municipality and motorists pay the bill for careless implementation and preparation. "If there should be an environmental zone, then a uniform, national policy must be in place," said the KNAC, a position that is still standing today. Furthermore, the court did not include the motion of the Lower House at the end of last year. It concerned the motion adopted that the board used to date for environmental zones should not apply to passenger cars. Finally, the ratio of pollution to other road users was not taken into account.

Hope established on Council of State

On December 6, the Council of State may therefore consider this form of judicial process. The decision in January was at odds with the findings of the court and the KNAC. In addition, it is also demonstrated in Rotterdam that the effect of the environmental zone cannot be measured. Perhaps these starting points can also be included in the assessment. Emissions know no boundaries and are part of a much larger picture. They affect Dutch and local air quality. These are also influenced by cross-border (read: abroad and the functioning of Mother Nature) factors. The Council of State would be honored if these considerations - in addition to the arguments mentioned by the KNAC - were taken seriously and implemented in a decent traffic policy. The decision will follow in a maximum of thirteen weeks. This may also come up earlier, because the Council of State can make a decision immediately after the meeting.
