The first test process in the fight against the current MRB rules for vintage cars has been completed. The first session of the lawsuit against the State initiated by Stichting Autobelangen - which is subdivided into five trial processes - provided provisional satisfaction within Wouter van Embden's club.
In Breda, on February 26, the case of Arjan Lenoir, owner of a BMW 535 i from 1985 and a member of the Autobelangen Foundation, was discussed. His E28 belongs to the gasoline category that qualifies for the transitional arrangement. Arjan Lenoir uses this. With his BMW, he represents one of the five groups recognized by the Tax Authorities that fall within the tax rules adjusted per 1 January 2014.
Court gives more than enough opportunity
The Car Interests Foundation in general and Arjan Lenoir in particular expressed satisfaction with the course of the first session. “The court has given more than enough opportunity and time to make the objections to the scheme known and to tell my personal story. Our lawyer was also given the opportunity to properly substantiate his argumentation. The feeling about today is very good, "says Lenoir.

One of the spearheads in this first case was - in addition to the now known starting points such as utility and necessity - the limitation that the owners of petrol cars can experience between 26 and 40 years old. According to Autobelangen, the low transition rate of € 121 per year is of secondary importance compared to the obstacle involved in the transition arrangement. “If you do not opt for the transitional arrangement, you pay the full pound. Also today it has been emphasized again that you will pay significantly more than if you decided to choose to take the car off the public road in December, January and February. When choosing a full MRB you drive all year round. In my case, the key budget is then halved, "says Arjan Lenoir. He further indicated that he can now also do little maintenance work on the 85 er Beier. “I'm not allowed on the road. So I can't drive to a workshop to do maintenance on my car. And I don't have the space to do it myself. "

Finally, the Car Interests Foundation found that the judges listened well. "And they wanted to know all about the matter, which was exceptionally well documented." Lenoir, on the other hand, did not find the tax authorities' argument very strong. “Every time they try to explain in a different way and to get them right. But on balance, their conclusion remains unacceptable. ”In any case, the court ruling in the first trial is expected within six weeks and it will become clear whether the good feeling is also a correct indicator.
