1. Definitions
In these terms and conditions shall apply:
Customer: the natural or legal person who has placed an order through a sales system organized by Wilbers Publishing or Wilbers Publishing's Customer Service.
Wilbers Publishing: the company Wilbers Publishing BV, publisher of, among other things, Auto Motor Klassiek and Het Automobiel Klassiekermagazine.

Order: an agreement between the customer and Wilbers Publishing for the delivery of a subscription, product, welcome gift or service.
Subscription: an agreement for a subscription to a magazine or digital publication.
Wilbers Publishing website: the Wilbers Publishing website, amklassiek.nl and all underlying and linked websites of Wilbers Publishing or mobile apps through which customers can enter into an agreement with Wilbers Publishing.
Distance contract: an agreement in which, within the framework of a system organized by the company for the distance sale of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication.
2 Applicability
2.1 These general terms and conditions apply to every offer from Wilbers Publishing and to every agreement concluded between Wilbers Publishing and the customer.
2.2 Before the agreement is concluded, the text of these general terms and conditions is made available to the customer. If this is not reasonably possible, for example because the order is placed by telephone, the customer can view the general terms and conditions via the Wilbers Publishing site or request them free of charge via customer service.
2.3 The provisions in these general terms and conditions can only be deviated from if this has been agreed in writing. In this case, the other provisions of these general terms and conditions will remain in full force.
2.4 Wilbers Publishing reserves the right to change these terms and conditions. If a change in the general terms and conditions contains a contradiction with the general terms and conditions that applied when placing the order, the customer can invoke the applicable provision that is most favorable to him. In the case of continuous subscriptions, the applicable provision that is most favorable to the buyer applies until the expiry date of the subscription. If the subscription starts a new extension period and the buyer has not made use of the option to cancel the subscription, the new conditions apply.
3 Place order
Customers can place orders through all sales channels organized by Wilbers Publishing. The only reservation is that the customer must be 18 years or older. Orderers who are younger than 18 years must have permission from their parent or guardian.
4 Conformity
4.1 Wilbers Publishing guarantees that the products, subscriptions and / or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the existing on the date of the conclusion of the agreement legal provisions and / or government regulations.
4.2 Wilbers Publishing strives to ensure that the images and descriptions in the offer correspond as closely as possible with reality. However, Wilbers Publishing cannot guarantee that the colors shown in the images with regard to the products are exactly the actual colors of the items to be supplied.
4.3 If the customer is of the opinion that Wilbers Publishing remains in default, the customer will follow the complaint procedure as described below.
5 Prices and payments
5.1 The prices quoted are in euros and include VAT, unless stated otherwise. For subscriptions and welcome gifts, shipping costs are included, unless explicitly stated otherwise in the offer. For individual items, the shipping costs are exclusive, unless explicitly stated otherwise in the offer.
5.2 For delivery of items to delivery addresses abroad, higher shipping costs may be charged than in the Netherlands. If applicable, this is explicitly stated on the order page or by Customer Service when the order is placed by the customer.
5.3 During the validity period stated in the offer, the prices of products, services and subscriptions offered are not increased, except for price changes as a result of changes in VAT rates, or other statutory regulations or provisions. In the case of subscriptions that are automatically extended after the first term, Wilbers Publishing reserves the right to implement a regular price change in subsequent terms. Any price changes are always communicated at least 2 months in advance via the colophon of the magazine. Customers of a subscription that has been increased in price after the expiration of the first term can appeal to the subscription price up to the expiry date of their subscription as it applied when the subscription was concluded. If the subscription has started a new extension period after this expiry date and the buyer has not made use of the option to cancel the subscription, the new subscription price is effective.
5.4 Payment can be made in (one of) the way (s) as indicated during the ordering process. Further (payment / order) conditions can be imposed on an order. When paying by bank or giro, the date of payment is the date of crediting the bank account of Wilbers Publishing.
5.5 Payment of a subscription takes place prior to each subscription period in a manner that the customer has accepted when placing the order (including direct debit, iDeal or invoice).
5.6 Formally a signature of the buyer is required for the collection of an automatic collection. This signature is not (yet) physically available via the internet. Customers who place an order via the Wilbers Publishing web shop agree that the collection of the specified account number will be carried out for the amount corresponding to the ordered subscription.
5.7 Reminder costs may be charged in the event of late payment, including cancellation of the debited amounts or due to an insufficient balance in the indicated account.
5.8 If the payment of a subscription is not received even after a reminder, Wilbers Publishing is entitled to terminate the subscription unilaterally and with immediate effect. Wilbers Publishing is then also entitled to claim any compensation and arrears.
6 New subscriptions and welcome gifts
6.1 New subscriptions can start at any time.
6.2 Discount offers and welcome gifts are only possible if the new subscriber has not had a subscription to the magazine in question in the past six months. If this is the case, the right to a discount or welcome gift expires.
6.3 The welcome gift will be sent to the subscriber up to six weeks after receipt of payment of the subscription fee. If the delivery of the welcome gift takes longer, the customer will be notified.
6.4 The buyer can contact info@amklassiek.nl if the welcome gift is delivered damaged.
6.5 The offer for a welcome gift is valid while stocks last. If the relevant welcome gift is no longer in stock, the buyer is entitled to an alternative gift or item or the relevant discount, all at the discretion of the buyer.
6.6 Wilbers Publishing is not liable for damage as a result of exceeding the announced delivery period of a welcome gift.
7 Duration of the subscription
7.1 A subscription is entered into for the period specified in the offer and is then automatically - unless canceled (see below) - automatically extended, unless stated otherwise in the offer.
7.2 The extension period is a maximum of one year. Information about the duration of your subscription is provided in the offer and when ordering and can also always be requested through Customer Service.
8 Cancellation of a subscription
8.1 An ongoing subscription can always be converted free of charge into another subscription from Wilbers Publishing.
8.2 To terminate a subscription, the customer must send a message to Customer Service prior to the publication of the last number of the first subscription term. This can be done by telephone, in writing and by email.
8.3 After the first subscription period has expired, the subscription can be terminated each month by sending a message to Customer Service. This can be done by telephone, in writing and by email.
8.4 If a subscription is terminated with immediate effect and there is still a remaining duration, Wilbers Publishing will not refund any remaining subscription fees.
9 Delivery and delivery
9.1 Wilbers Publishing takes the greatest possible care when executing the order and the delivery and delivery of products and subscriptions. In the unlikely event that a product has not arrived on time or has been damaged, the customer will contact Customer Service. If a magazine is not delivered on time or not, the magazine will be delivered within 5 working days after the Customer Service has received the message from the customer about this.
9.2 In the event of a change in the delivery address of a subscription, the customer informs Customer Service 3 weeks before the commencement date about the address change via email or letter. If the Customer Service receives the change of address later, Wilbers Publishing cannot guarantee the uninterrupted continuation of the delivery.
9.3 If delivery of an ordered product appears to be impossible, Wilbers Publishing will endeavor to make a replacement item available. At the latest at the time of delivery, it will be stated in a clear and comprehensible manner that a replacement item will be delivered. With replacement items, the right of withdrawal (see below) remains in force. The costs of the return shipment are for a replacement item for Wilbers Publishing. If Wilbers Publishing cannot supply a replacement article, the customer will also be notified. The order will then expire. In this case, the buyer receives the amount paid back to his or her bank or giro account.
9.4 Wilbers Publishing reserves the right to stop publishing a magazine. In this case, it has a duty to inform buyers of a subscription in writing in good time. Wilbers Publishing is not obliged to carry out further deliveries after termination. Customers with a subscription are entitled to a refund of the part of the prepaid subscription fee that has not been covered by a delivery, unless a comparable replacement is offered.
10 Right of withdrawal
When purchasing products, the customer has the option to dissolve the agreement without giving any reason during 14 days. This period starts on the day after receipt of the product by or on behalf of the customer. During this period the buyer will handle the product and the packaging with care. He will only unpack or use the product to the extent necessary to assess whether the product meets the specifications in the offer. If he exercises his right of withdrawal, the customer will contact Customer Service within the period of 14 days. The buyer will then receive a return number, reply number, zip code and place name. The buyer enters this data on the return sticker. The customer then returns the item in or with the original packaging with the return sticker. The subscriber is entitled to a refund of the amount paid or a replacement item after the original order has been received back by Wilbers Publishing. The shipping costs of the return shipment are for the account of the buyer.
11 Privacy and Personal Data Protection Act
Wilbers Publishing is responsible for processing the customer data that is collected when entering into new subscriptions with the aim of I) implementing the agreement between Wilbers Publishing and the subscriber and II) to keep records of all subscribers . Wilbers Publishing respects the privacy of its subscribers.
The subscriber acknowledges that he has been informed of the collection and disclosure of his personal data and the use that can be made of it and the subscriber agrees with the privacy policy of Wilbers Publishing
12 Complaints and disputes
12.1 Complaints about the implementation of the agreement must be fully and clearly described by email or letter to the Wilbers Publishing customer service, as soon as possible after the customer has found the defects.
12.2 Complaints submitted in this way to Wilbers Publishing will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Wilbers Publishing will notify 14 within days, with a message of receipt and an indication when the customer can expect a more detailed answer.
12.3 Wilbers Publishing wants to deal adequately and carefully with customer complaints. If the buyer is of the opinion that Wilbers Publishing does not achieve this objective, the management will appreciate it if the buyer contacts her in writing. The contact details of the management can be found on the website of Wilbers Publishing.
13 Liability
Wilbers Publishing is liable for damage suffered by the customer if this damage comes at the risk of Wilbers Publishing pursuant to legal provisions. Wilbers Publishing is not liable for damage resulting from the use by buyers of any article supplied by Wilbers Publishing, unless Wilbers Publishing is liable on the basis of the product liability provisions as referred to in article 6: 185 et seq. Wilbers Publishing is not liable for any damage if it is caused by a shortcoming that is the result of force majeure. Force majeure is present if the shortcoming is the result of circumstances beyond the control of Wilbers Publishing, including at least: war or similar situations, riot, sabotage, boycott, strike, occupation, blockade, illness of Wilbers personnel Publishing, failures of Wilbers Publishing suppliers and / or carriers, measures taken by the government (including a foreign government) such as a transport, import or production prohibition, natural disasters, bad weather, lightning, fire, explosion and outflow of hazardous substances or gases . None of the above applies in the event of intent or gross negligence on the part of Wilbers Publishing. Subscriber must prove that there is intent or gross negligence on the part of Wilbers Publishing. Wilbers Publishing is not liable for any damage that occurred after the delivery of the article and that was not notified to Wilbers Publishing in writing within 14 days of publication. If the damage arises later, Wilbers Publishing will inform the subscriber at his or her request about any recovery of the damage from the supplier.
The subscriber is not permitted to set off any alleged claim for compensation against any amount that Wilbers Publishing owes the subscriber pursuant to any agreement between Wilbers Publishing and the subscriber.
The product conditions, including subscription prices, are subject to obvious printing and typesetting errors.
14 Other provisions
14.1 Dutch law applies exclusively to these General Terms and Conditions.
14.2 These General Terms and Conditions enter into force with effect from 1 June 2014. Previously published Delivery Terms expire on that date.
